Restaurant Terms of Use

Hotel Metropolitan Nagano Co., Ltd. (hereinafter referred to as “Hotel”) has established the following Terms of Use (hereinafter referred to as “Terms”) of the restaurants that the Hotel manages directly within the Hotel. Please understand in advance that these Terms apply when you use a restaurant.

           

(Business hours)
Article 1.  Information on the business hours and closed days of restaurants is provided on the website, brochures and various displays. Business hours and fees are subject to temporary changes during special periods such as Christmas, the year-end, New Year holidays, etc., or if necessary and unavoidable. In such cases, we will provide notification on the website, etc.

           

(Refusal of use and cancellation of reservation or contract)
Article 2.  We will refuse use (including reservations and contracts for use) in the cases listed in the following items. In addition, we will cancel a reservation or contract if such fact is found even after a reservation or contract has been concluded. The conclusion of a reservation or contract will be deemed to have been established when the Hotel has accepted an application from a customer. However, conclusion will not be established if it is proved that the Hotel has not accepted the application.

           
  1. (1) If any of the items listed below applies to a user
    1. ① When the Hotel judges that the user is a member of an organized crime group under Article 2, Item 6 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) or belongs to antisocial forces, including a person related to a company or organization that has a relationship with a member of an organized crime group under Article 2, Item 2 of the same act (hereinafter referred to collectively as “Antisocial Forces”)
    2. ② When the Hotel judges that Antisocial Forces have a relationship with a corporation or other group that controls business activities
    3. ③ When the Hotel judges that there is a person classified as Antisocial Forces among the officers of a corporation, and an intimidating act such as violence, threats or extortion has been carried out against the Hotel or an employee, or an unreasonable burden has been demanded of the same
    4. ④ When it is recognized that acts similar to those of ③ were carried out at the Hotel or another hotel in the past
  2. (2) When the Hotel judges that the user has made a violent demand against or demanded an unreasonable burden from the Hotel or an employee (Excluding cases where the person intending to use a restaurant requests the removal of social barriers based on the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act for Eliminating Discrimination against Persons with Disabilities (Act No. 65 of 2013; hereinafter referred to as the “Act for Eliminating Discrimination”))
  3. (3) When the Hotel judges that the user is engaging in language or behavior that causes significant nuisance to other guests, such as being drunk or engaging in language or behavior that is significantly abnormal
  4. (4) When the Hotel judges that the user’s body or clothes are filthy and may cause nuisance to other users
  5. (5) When it is recognized the user will be clearly unable to pay
  6. (6) When a customer who will use a restaurant is clearly infected with an infectious disease, or has another disease that may cause illness by infection
  7. (7) When the content of a reservation or contract (purpose of use) differs from the time of application and a false statement is clearly made
  8. (8) When the Hotel judges that guest slippers, sandals or other clothes are not appropriate for a restaurant
  9. (9) When the Hotel judges that the provisions of these Terms are not followed
  10. (10) When a restaurant cannot be used due to a natural disaster, a breakdown of facilities or other unavoidable reason
  11.            

    (Prohibitions)
    Article 3.  The restaurant cannot be used when the Hotel judges that any of the matters listed in the following items applies.

               
    1. (1) Bringing in of a dog (excluding assistance dogs stipulated in law), cat, small bird or other pet or livestock
    2. (2) Bringing in of an ignitable or flammable item or dangerous item
    3. (3) Bringing in of a foul-smelling item
    4. (4) Bringing in of food and drink purchased at another store or otherwise personally owned without permission
    5. (5) Acts in violation of laws and regulations or public order and morality, or language or behavior that may cause nuisance or discomfort to other customers
    6. (6) Movement of furnishings, fittings, etc., damaging or taking away equipment, fixtures, fittings, etc.
    7. (7) Smoking in a restaurant
    8. (8) Bringing in of firearms, swords, narcotics, etc., whose possession is prohibited by laws and regulations
    9. (9) Distribution of advertising or promotional materials, sale of goods, acts of solicitation, etc.
    10. (10) Use of mobile phone (calls) while seated
    11. 2. In addition to the items of the preceding paragraph, please refrain from using strongly fragrant perfumes as they cause nuisance to other customers and damage the aroma of food.
               

    (Cancellation policy)
    Article 4.  If a reservation is cancelled, the Hotel will charge the following cancellation fees.

    * In cases of seat-only reservations, the Hotel will charge the cancellation fees based on the following standard fees.

    Lunch time (weekdays) 2,000 yen per person
    Lunch time (Saturday, Sunday and public holidays) 2,500 yen per person
    Dinner time 4,500 yen per person
               

    (Disclaimer)
    Article 5.  If any of the following items applies, the Hotel will be exempted from its obligations.

               
    1. (1) Damage to a customer that arises due to products provided by the Hotel without advance notice concerning food allergies, food prohibited for religious reasons, etc.
    2. (2) Changes to the details of food, utensils, etc., due to the season, weather, availability, etc.
    3. (3) Theft or loss of the baggage of a customer who did not deposit it at the cloakroom
      * The Hotel cannot accept cash, valuables, spoiled or easily-damaged items, etc.
               

    (Changes to these Terms)
    Article 6.  The Hotel may change these Terms at its own discretion.

     
    1. 2. If the Hotel changes these Terms, the fact it has done so, the details of the changed Terms and the effective date thereof will be posted on the Hotel website by one month prior to the effective date.
    2. 3. When a customer has used Hotel services based on these Terms from the effective date of changed Terms on, the customer will be deemed to have consented to the changes to these Terms.
               

    (Governing law and agreed jurisdiction)
    Article 7.  The interpretation and effect of these Terms are governed by the law of Japan.

     
    1. 2. The customer and the Hotel hereby agree that the Nagano District Court has exclusive jurisdiction in the first instance over any judicial dispute that occurs in connection with these Terms.

      (Takeout of Leftovers from Food and Beverage Facilities)
      Article 8.  Purpose and Basic Concept

                 
      1. (1) Reducing food loss is an international goal set within the SDGs and remains a significant issue in Japan. While the most important approach is for customers to enjoy their meals and finish them at the restaurant, taking home leftovers upon request can also be an effective measure to reduce food waste. In line with this perspective, our establishment actively promotes the takeout of uneaten food and beverages.
      2. (2) As there is a risk of food poisoning when taking home leftovers, customers are required to fully understand the hygiene precautions explained by our staff and assume personal responsibility when doing so.
      3. (3) Customers are responsible for transferring their leftovers into the provided containers themselves.
      4. (4) Customers must manage the transportation and storage of their takeout food at their own responsibility.
      5. (5) If customers give the takeout food to family members or others, they must also explain the necessary precautions provided by our establishment to the recipient.
      6. (6) If any family member or recipient has food allergies, please refrain from sharing the takeout food with them.

      2. Our establishment assumes no responsibility for any food poisoning or other incidents arising from the customer's handling of takeout food, whether during transportation or after consumption.
